Schedules of condition in case of works
All contractors of road works, construction works and demolition works best have a detailed schedule of condition drawn up prior to commencing the works. After all, the contractor is obliged to cause no damage to third parties. If damage is done to adjacent buildings, roads or infrastructure during the works, the contractor is responsible for repairs or compensation. As such, the schedule of condition is a very important piece of evidence to later resolve disputes with local residents or the government. it is also important to draw up an extra schedule of condition during the works if calamities happen, or if multiple contractors work right after one another, so the right party can be held accountable. It is also important to have a schedule of condition drawn up after the works are finished, even though there is no damage, so the file can be closed.
If the contractor has no schedule of condition drawn up – it will be harder to produce evidence in that case - he risks paying for already existing damage.
If necessary we can draw up the schedule of condition in French, English or German.
Of course, the contractor and builder should not refrain from taking out a liability insurance and a builder's risk insurance.
